Polysparks Terms of Service
Effective Date: 2026-09-21
Last Updated: 2026-09-27
PLEASE READ THESE TERMS CAREFULLY. THEY INCLUDE: (A) AN ACKNOWLEDGMENT THAT JOB RECOMMENDATIONS ARE PRODUCED WITH AI, ARE INFORMATIONAL ONLY, AND MAY BE WRONG (SECTIONS 5 AND 8); AND (B) A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER (SECTION 18) THAT AFFECT HOW DISPUTES BETWEEN YOU AND POLYSPARKS ARE RESOLVED.
YOU APPLY FOR JOBS YOURSELF. Polysparks links you to each posting on the employer's own site. It does not prepare, fill, or submit applications for you.
1. Agreement to These Terms
These Terms of Service (these "Terms") are a legally binding agreement between you ("you" or "User") and Polysparks ("Polysparks," "we," "us," or "our"), whose contact address is in Section 22. These Terms govern your access to and use of the Polysparks website and all related products and services (collectively, the "Services").
By creating an account, or by otherwise accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not access or use the Services.
2. Definitions
- "Job Listing" means a job, internship, or similar opportunity displayed or recommended through the Services.
- "Report" means an assessment of Job Listings against your resume and preferences produced through the Services, including its Apply or Skip verdicts and the reasons given for them.
- "Third-Party Platform" means any website, application, applicant tracking system, job board, or employer career portal not owned or controlled by Polysparks.
- "User Materials" means the information you provide to the Services, including your name, email address, resume, the education, work history, skills, and other details drawn from it, and your work preferences.
3. Eligibility
You may use the Services only if you: (a) are at least 18 years old; (b) have the legal capacity to enter into a binding contract; (c) are not barred from using the Services under applicable law; (d) are not located in, ordinarily resident in, or a national of any country or region subject to comprehensive U.S. sanctions or embargoes, and are not on any U.S. government restricted-party list; and (e) are using the Services for your own job search. You may not use the Services on behalf of anyone else. The Services are operated from the United States; you are responsible for compliance with the laws of the place from which you access them.
4. Your Account
You must register an account to use the Services. You agree to provide accurate information and to keep it current. You are responsible for keeping your Polysparks credentials confidential and for activity under your account. Notify us at contact@polysparks.com if you suspect unauthorized use. We may suspend or terminate accounts we reasonably believe are compromised, fraudulent, duplicative, or in violation of these Terms.
5. The Services
5.1 The job board. The Services display live Job Listings gathered from employers' public career sites and applicant tracking systems, which you can filter by location, career, level, workplace, and similar criteria, and save to a shortlist.
5.2 Profile and preferences. You provide your resume and work preferences. The quality of a Report depends on the accuracy and completeness of what you give us.
5.3 Job filtering and AI matching. The Services filter live Job Listings against your stated preferences, then use AI to assess the remaining ones against your resume and report which fit. Matching is probabilistic and imperfect: relevant opportunities may be filtered out, irrelevant ones may be recommended, and Job Listings may be inaccurate, expired, duplicated, or fraudulent despite our efforts. Recommendations are informational only and are not career, legal, or professional advice.
5.4 You apply yourself. When you choose to apply to a Job Listing, you do so on the employer's own site, under that site's terms. Polysparks does not fill in, prepare, or submit applications, and does not create or sign in to accounts on employer sites for you. Everything you submit to an employer is yours, and you are responsible for its accuracy.
5.5 No employment relationship or guarantee. Polysparks is a software platform. We are not an employer, employment agency, recruiter, staffing firm, or agent of any employer, and we do not make, influence, or participate in hiring decisions. We do not guarantee that any application you make will be received, reviewed, or accepted, or that you will obtain an interview, offer, or employment. All hiring decisions are made solely by employers.
5.6 Availability and changes. We may modify, add, or discontinue features, including coverage of particular employers or Third-Party Platforms, at any time. Some features are in limited release and are not available to every account. Features identified as beta, preview, or limited release are provided with reduced or no support obligations and may be changed or withdrawn at any time.
6. Third-Party Platforms and Job Listings
6.1 Independent services. Third-Party Platforms and employers are independent of Polysparks. We do not control and are not responsible for their content, availability, terms, privacy practices, security, or conduct. Your use of a Third-Party Platform, including when you follow a link from the Services to apply, is subject to that platform's own terms and policies.
6.2 Job Listings; fraud. Job Listings originate from third parties. We do not guarantee their accuracy, completeness, lawfulness, authenticity, or continued availability. Although we try to filter fraudulent or misleading listings, some may appear. Never pay money, buy equipment, or share financial account details as a condition of applying for or accepting a job. Report suspicious listings to contact@polysparks.com.
7. User Materials; License; Your Representations
7.1 Ownership. You retain all rights you hold in your User Materials.
7.2 License to Polysparks. You grant Polysparks a worldwide, non-exclusive, royalty-free, sublicensable to our service providers, license to host, store, reproduce, process, adapt, reformat, transmit, and display your User Materials solely: (a) to provide, maintain, secure, and support the Services, including assessing Job Listings against your resume and producing Reports; (b) to comply with law; and (c) as otherwise described in our Privacy Policy. This license ends when you delete the relevant User Materials or your account, except to the extent copies must be retained for legal or security purposes as described in the Privacy Policy. We do not use your User Materials to train AI models, and our AI provider is contractually prohibited from using data we send it to train theirs.
7.3 Your representations. You represent and warrant that your User Materials: (a) are true, accurate, and current; (b) are yours or you hold all rights necessary to grant the license above; and (c) do not violate any law or any third party's rights, including intellectual property, privacy, or confidentiality obligations to a current or former employer.
7.4 Feedback. If you send us suggestions or feedback, we may use them without restriction or obligation to you.
8. AI Disclosures and Limitations
The Services rely on AI, which is inherently probabilistic. AI outputs, including the reading of your resume, job-fit assessments, Reports, and the reasons given for them, may be inaccurate, incomplete, or outdated, and may omit strong matches or include weak ones. The Services do not provide legal, immigration, tax, or professional career advice. You are responsible for reviewing recommendations and for your own decisions about where and how to apply. Section 3 of our Privacy Policy describes what information is sent to our AI provider.
9. Fees, Subscriptions, and Payment
9.1 Subscription plans. Some features of the Services require a paid subscription. The current plan, its features, its billing period, and its price are shown in the product and at checkout, and the price at checkout governs. Prices exclude taxes unless stated otherwise; you are responsible for applicable taxes, which will be added where we are required to collect them.
9.2 Auto-renewal and cancellation. Subscriptions renew automatically at the end of each billing period, and the then-current fee is charged to your payment method, until you cancel. You may cancel at any time through the billing portal reachable from your account menu, or by emailing contact@polysparks.com. Cancellation takes effect at the end of the current billing period and you keep access until then. We will give advance notice of any price increase, effective no earlier than your next renewal; if you do not agree, cancel before it applies.
9.3 Free trials and promotions. We do not currently offer a free trial. If we introduce one, its terms will be disclosed at sign-up, and unless you cancel before it ends your paid subscription will begin automatically.
9.4 Refunds; statutory withdrawal rights. Except where the law requires otherwise, subscription fees are non-refundable. If you are a consumer in the EEA or the United Kingdom, you have a statutory right to withdraw from a contract for digital services within 14 days of purchase. By asking for the Services to begin immediately, you consent to immediate performance; if you then withdraw within the 14 days, you will owe a proportionate amount for the service already provided, and you lose the right of withdrawal once the service has been fully performed. Nothing in these Terms limits refund or cancellation rights granted to you by consumer law that cannot be waived.
9.5 Payment processing. Payments are processed by Stripe. We never receive or store your full card number. You authorize us and Stripe to charge your designated payment method for fees due. If a payment fails or is past due, we may retry it and may suspend or terminate paid features after notice.
10. Acceptable Use
You agree not to, and not to attempt to:
- use the Services on behalf of any person other than yourself;
- provide false or misleading information in your account or User Materials, or misrepresent your identity;
- use the Services for any unlawful purpose or in violation of applicable law;
- use the Services in a way intended to harass employers, or exceed any rate or volume limits we impose;
- access another person's Polysparks account;
- probe, scan, or test the vulnerability of the Services, breach or circumvent any security or authentication measure, or interfere with the operation of the Services;
- scrape, harvest, or bulk-extract data from the Services, or use the Services to build a competing product;
- reverse engineer, decompile, or disassemble any part of the Services, except to the extent the law permits notwithstanding this restriction;
- upload viruses, malware, or other harmful code; or
- resell, sublicense, rent, or provide the Services to third parties as a service bureau.
We may investigate suspected violations and may suspend or terminate access and cooperate with law enforcement where appropriate.
11. Intellectual Property
The Services, including all software, interfaces, designs, text, graphics, and trademarks, excluding your User Materials and Third-Party Platform content, are owned by Polysparks or its licensors and protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial job search. No other rights are granted. "Polysparks" and our logos are our trademarks; you may not use them without our prior written permission.
If you believe content on the Services infringes your copyright, send a notice compliant with 17 U.S.C. § 512 to contact@polysparks.com.
12. Privacy
Our collection, use, and disclosure of personal information — including your resume, your preferences, and your Reports — are described in our Privacy Policy. By using the Services, you acknowledge the Privacy Policy.
13. Communications
You consent to receive transactional and service communications from us electronically, such as security alerts, support replies, and notices about these Terms, and you agree that electronic notices satisfy any legal requirement that communications be in writing. We do not currently send marketing email; if we begin, you may opt out at any time via the unsubscribe link, and service communications will continue while you have an account.
14. Term, Suspension, and Termination
These Terms apply from your first use of the Services until terminated. You may stop using the Services at any time, and you may delete your account from the account menu or by emailing contact@polysparks.com. If you have an active subscription, cancel it first; deletion is refused while a subscription is set to renew. We may suspend or terminate your access, or any feature, at any time, with or without notice, if we reasonably believe you have violated these Terms or pose a risk to Polysparks, other users, or third parties, or if the law requires it; we may also terminate for convenience with reasonable notice.
Upon termination: (a) your license to use the Services ends; (b) your account data is deleted as described in the Privacy Policy; and (c) Sections 6, 7.2 to the extent of retained copies, 7.3, 8, 9 as to accrued fees, 11, and 15–21 survive.
15. Disclaimers
THE SERVICES, INCLUDING ALL AI OUTPUTS, JOB LISTINGS, REPORTS, AND RECOMMENDATIONS, ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WITHOUT LIMITING THE FOREGOING, POLYSPARKS DOES NOT WARRANT THAT: (A) ANY RECOMMENDATION OR REPORT IS ACCURATE OR COMPLETE; (B) ANY APPLICATION YOU MAKE WILL BE RECEIVED, REVIEWED, OR ACCEPTED BY AN EMPLOYER; (C) YOU WILL RECEIVE ANY INTERVIEW, OFFER, OR EMPLOYMENT; OR (D) JOB LISTINGS ARE ACCURATE, CURRENT, OR GENUINE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW: (A) POLYSPARKS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF EMPLOYMENT OR EMPLOYMENT OPPORTUNITIES, LOST WAGES OR PROFITS, LOST DATA, OR REPUTATIONAL HARM, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE; AND (B) POLYSPARKS' TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (i) THE AMOUNTS YOU PAID TO POLYSPARKS IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY AND (ii) ONE HUNDRED U.S. DOLLARS (US$100). THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING LIABILITY ARISING FROM POLYSPARKS' GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR FRAUD. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
17. Indemnification
You will defend, indemnify, and hold harmless Polysparks and its officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to: (a) your User Materials, including any misrepresentation; (b) your use or misuse of the Services; (c) your violation of these Terms or of applicable law; or (d) your violation of any third party's rights or of the terms of any Third-Party Platform. We may assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with our defense.
18. Dispute Resolution; Binding Arbitration; Class Action Waiver
18.1 Informal resolution first. Before filing a claim, you and Polysparks agree to try to resolve the dispute informally. The complaining party will send a written notice describing the dispute to contact@polysparks.com or to the address in Section 22, and the parties will negotiate in good faith for 60 days.
18.2 Arbitration. If not resolved informally, any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration administered by JAMS under its Consumer Arbitration Minimum Standards and applicable rules, rather than in court, except that either party may (a) bring an individual claim in small claims court, or (b) seek injunctive relief in court for infringement or misuse of intellectual property or unauthorized access to the Services. The arbitration will be conducted in San Mateo County, California, or remotely by videoconference at your election. The Federal Arbitration Act governs this Section. Arbitration fees are allocated under the administrator's consumer rules, and Polysparks will pay the filing, administration, and arbitrator fees that those rules require it to bear.
18.3 Class action and jury waiver. YOU AND POLYSPARKS EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. Claims may be brought only in an individual capacity. If the class waiver is found unenforceable as to a particular claim, that claim, and only that claim, will proceed in court.
18.4 Opt-out. You may opt out of this arbitration agreement by emailing contact@polysparks.com within 30 days of first accepting these Terms, stating your name, account email, and that you opt out of arbitration. Opting out does not affect any other provision of these Terms.
18.5 Consumers outside the United States. If you are a consumer residing outside the United States, this Section applies only to the extent the mandatory laws of your country of residence permit. Where those laws do not permit pre-dispute arbitration agreements or class action waivers for consumers, this Section does not apply to you, and you may bring and defend claims in the competent courts of your country of residence under its mandatory consumer protection laws.
19. Governing Law and Venue
These Terms and any dispute arising out of them are governed by the laws of the State of California, without regard to conflict-of-laws principles, except that the Federal Arbitration Act governs Section 18. Subject to Section 18, the exclusive venue for any claim not subject to arbitration is the state or federal courts located in San Mateo County, California, and both parties consent to personal jurisdiction there. Nothing in this Section deprives you of the mandatory consumer protections of the jurisdiction where you reside.
20. Changes to These Terms
We may update these Terms. If we make material changes, we will give notice, for example by email or in the product, at least 14 days before they take effect, except for changes required by law or addressing new features, which may take effect immediately. Continuing to use the Services after the effective date constitutes acceptance; if you do not agree, stop using the Services and ask us to close your account before the changes take effect.
21. General
These Terms, together with the Privacy Policy and any additional terms you accept for specific features, are the entire agreement between you and Polysparks regarding the Services and supersede prior agreements on that subject. If any provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remainder will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, sale of assets, or by operation of law. Neither party is liable for delay or failure caused by events beyond its reasonable control. There are no third-party beneficiaries of these Terms. Section headings are for convenience only. These Terms are drafted in English; any translation is for convenience, and to the extent applicable law permits, the English version controls in the event of a conflict.
